Yes. Surrogacy is legal in Canada; however, it is governed by the Assisted Human Reproduction Act (AHRA). It is illegal to pay a surrogate for carrying a pregnancy, but surrogates may be reimbursed for legitimate, documented expenses related to the pregnancy. Non-compliance can result in significant fines or penalties.
Trust Management helps avoid financial tension during the journey. Ontario Surrogacy sets up and manages a reimbursement account so the surrogate submits expenses directly to us rather than discussing finances with Intended Parents.
Surrogates are pre-screened through Ontario Surrogacy and must pass a psychological evaluation. Additional medical screening is completed through the fertility clinic at the Intended Parents’ expense.
Yes. Independent legal counsel is strongly recommended for both parties. Legal services typically include drafting and signing the Surrogacy Agreement and obtaining a Declaration of Parentage after birth.

Yes, but additional considerations may apply, including hospital billing policies and potential newborn hospital stay costs. It is recommended that Intended Parents contact the delivering hospital in advance.
